The Elliot Larsen Civil Rights Act - Fair Housing Law

Intro - AN ACT to define civil rights; to prohibit discriminatory practices, policies, and customs in the exercise of those rights based upon religion, race, color, national origin, age, sex, height, weight, familial status, or marital status; to preserve the confidentiality of records regarding arrest, detention, or other disposition in which a conviction does not result; to prescribe the powers and duties of the civil rights commission and the department of civil rights; to provide remedies and penalties; to provide for fees; and to repeal certain acts and parts of acts.

The People of the State of Michigan enact:

ARTICLE I

Sec. 101. This act shall be known and may be cited as the “Elliott-Larsen Civil Rights Act.”

A Summary of key Michigan fair housing Laws compiled by the Fair Housing Center Of Metropolitan Detroit.

Intro - CIVIL RIGHTS ACTS OF 1866 AND 1870

Passed at the conclusion of the U.S. Civil War, the provisions of the Acts were routinely ignored in relation to housing transactions until 1968, when the U.S. Supreme Court ruled that the 1866 law prohibits all forms of racial discrimination in the sale or rental of housing. The 1870 Act addresses the making of “contracts”, including property contracts, and was intended to insure that “all persons” shall have the “full and equal benefit of all laws” as is enjoyed by “white citizens”. The 1866 law specifically addresses “property rights”, as follows:

“All citizens of the United States shall have the right, in every State and Territory, as is enjoyed by white citizens thereof to inherit, purchase,
lease, sell, hold, and convey real and personal property.”
